Community
Support Programme
To support communities
in their initiatives to exercise their land rights,
access land and use that land to improve their livelihoods.
As the Community
Support Programme is Nkuzi 's largest area of work it
is divided into three sub programmes.
Supporting
Land Reform Implementation (Restitution and Redistribution)
Objective:
Prioritised communities
have done everything necessary in order to gain land through
the government land reform programme and where necessary
are developing there own initiatives to ensure that they
get land.
This objective will be
achieved with ten land claimant groups and three redistribution
projects. A further five projects will be worked with
and have made significant progress towards this objective.
Main Activities:
- Conduct advanced community, deeds and archival research
on claims
- Identify and train claimant/beneficiary verification
form fillers
- Run workshops on legal entities, draft constitutions,
facilitate elections of committees
- Consolidate CPA or Trust documents and submit to PDLA
or the High Court for registration
- Liaise with CRLR, DLA and other stakeholders
- Convene meetings with stakeholders and support communities
during negotiations
- Refer cases to Legal Unit for legal assistance when
the need arises
- Compile and submit to the relevant authorities comprehensive
documentation on each claim or redistribution project
- Support communities in creating development and settlement
strategies for land they acquire
- Identify and involve other service providers that
can assist the projects to be a success
- Ensure that each community participates in training
to assist in the effective running of the project

Farm resident
Support Programme
Objectives:
Farm residents worked
with are informed of their rights and assisted in exercising
those rights in particular eviction of farm residents are
prevented or equitable alternatives are provided.
This programme will be implemented in the Limpopo Province
and Gauteng and will deal with at least eighty cases in
each province
Main
Activities:
-
Inform farm residents of their rights and responsibilities
in terms of the constitution and relevant legislation
(ie; Extension of Security of Tenure Act, Land Reform
Labour Tenants Act, Interim Protection of Informal Land
Rights Act, Prevention of Illegal Eviction and Occupation
of Land Act, Basic Conditions of Employment Act, and
the Labour Relations Act) and the role of Nkuzi
- Gather information from clients and farm owners
- Inform owners about the rights of residents and workers
- Initiate and facilitate negotiations and conflict
resolution with land owners and support farm residents
in negotiations. Where possible facilitate settlements
through agreements
- Assist in laying criminal charges, bringing civil
claims for damages and taking labour matters to the
CCMA and support workers in court and CCMA processes.
- Arrange legal assistance where required and support
residents during legal procedures
- Look for assistance to meet immediate needs e.g healthcare,
food and shelter
- Liaise with relevant government departments, local
governments and other potential service providers
- Monitor the progress of cases and continue to give
feed back to the clients on new developments
- Identify issues specifically affecting women
- Identify and take up issues of health and safety for
women and children
- Publicise cases through the media
- Assist in preparing proposals for long term tenure
security and submit to DLA or other relevant authorities.
Continue to follow-up on these proposals
- Carry out rights enquiries to establish the nature
of rights and to identify all rights holders and beneficiaries
in each project
- Support establishment of local eviction response and
land rights forums involving local structures

Policy and Research
To develop and promote meaningful strategies for agrarian
reform in South Africa that will cover all aspects of land
reform and respond to the aspirations of landless people
within the real constraints that exist.
A large part of this work will be implemented in cooperation
with The Programme for Land and Agrarian Studies at the
University of the Western Cape, the National Land Committee
and the Southern African network on Land. The main aim of
this is to ensure that the various pieces of work compliment
each other in developing a workable alternative vision and
policy framework for agrarian reform. The attached co-operation
agreement (appendix 1) gives more information on this.
Main
Activities:
- Collect,
store and disseminate information on land reform and
related issues including all the latest policy positions
from government
- Document Nkuzi experiences in key areas of land reform
- Conduct research projects on land and agrarian issues
- Publish occasional papers dealing with agrarian reform
issues
- Establish and maintain a web site for Nkuzi with up
to date information on Nkuzi activities and agrarian
reform debates.
- Identify
key policy issues and draft Nkuzi positions on these
based on experiences and positions of communities that
Nkuzi works with

policy statements to government and other relevant bodies
Publish positions in the media
- Lobby public representatives, officials and political
parties
- Network and organise joint activities with other organisations
- Support community land struggles and community structures
with information on land reform and ideas for policy
options
- Pro-actively
update Nkuzi staff and clients on policy developments
